Customer Terms & Conditions

 
These Terms and Conditions relate to all and any agreement when you buy products from the website www.uniquelycrafted.co.uk. Details of the consideration (price you pay and what will be supplied) will be in an Order Confirmation.  
 
Definitions
“Website” means the website and all contents at www.uniquelycrafted.co.uk
“Artist” means either any person or organisation who is offering hand-made products on the website
“user” or “you” means anyone using and/or visiting the website
“we” or “us” means Uniquely Crafted LTD whose registered address is 2nd Floor, 145 – 157 St John Street, London, EC1V 4PY and whose Company Registration number is 06324722.


1.  Products  
(1) In this agreement the “Goods” or “Products”  are those items available for sale on the website or supplied as detailed on the Order Confirmation. At all times, all products are subject to availability.
(2) The website is merely a “showcase” for hand-made one-of-a-kind items. We facilitate the Artist. Products are sold by and will be supplied directly from these Artists and not from us. Any agreement that you have to purchase is directly with the individual Artist who exhibits the products on the website, subject to these Terms & Conditions.
(3) Artists are responsible for listing their own products on the website. Items are offered with information provided to the best of the Artist’s ability and based on available information and facts, including information and facts from manufacturers of components. Any opinion, statement, recommendation, or anything whatsoever shall not form a guarantee or warranty, implied or otherwise, and NO representation is made about any product.  
(4) You are aware that use of the website and/or the purchasing of any product does not constitute any form of warranty or guarantee and you enter into any agreement with that understanding.
 
2.  Ordering
(1) You order using our basket checkout system.
(2) Orders are subject to acceptance and are in accordance with these Terms and Conditions.
(3) Submitting an order is neither an acceptance nor confirmation of your order, irrespective of any automated response received by you.
(4) Artists reserve the right to refuse to supply any order which they or we suspect to be connected with fraud or for any other reason.
(5) Upon receipt of your order we will process your chosen method of payment and pass details onto the Artist. If the Artist is unable to supply the products, they will inform you of this within 7 days and advise of when the item will be available or make a refund.  
(6) When the Artist despatches products to you this will be the Artist’s acceptance of your order and will denote the completion of your contract with the Artist unless you have been notified your order has not been accepted or you have cancelled it.
(7) Artists reserve the right to suspend the supply of products at any time, without notice.
 
3.  Abide By Terms  
By making use of our organisation and the website and ordering Artist’s products you will be deemed to be aged 18 or over, are not under any disability which would impair your judgement or use of the site or its products, and that you have read and understood this agreement and agree to be bound by its Terms and Conditions. Where you are entering into an agreement on behalf of an organisation you confirm that you have the legal right to do so.
 
4.  Payment
(1) The price of the products is as displayed on the website at the time of ordering.
(2) All prices are shown, and payment must be made, in Pounds Sterling (GBP) and include VAT (where applicable) at the applicable current rates but exclude delivery charges, unless expressly stated otherwise. You will be advised of delivery charges before completing checkout.
(3) We reserve the right to increase prices without prior notice, subject to 4(1) above.
(4) Payment for items must be made when placing the order by using Paypal, and most Debit cards and Credit cards are accepted.  We also accept cheques made payable to Uniquely Crafted Ltd and sent to us at
2nd Floor, 145 – 157 St John Street, London, EC1V 4PY (you will still need to fill in the online order form and your item will not be sent out until the cheque has cleared).
(5) Payment will not be deemed to have been received and cleared until it has been processed and either transferred to and reached our account or authorised by your payment provider as we, at our discretion, determine.
(6) Products will not be despatched until we have cleared payment. The title in any products will not pass to you until full cleared payment is received.
(7) All card and Paypal transactions are conducted through 3rd party service providers and we do not at any time have access to your credit card details.
 
5.  Delivery
(1) Any delivery charges quoted are for delivery to addresses in mainland Britain. Please contact us to arrange a quotation for the Channel Islands, Scottish Highlands and Northern Island. We currently do not ship overseas.
(2) Delivery of some items may be by a service which requires a signature on receipt. Signing it confirms receipt and also the acceptable condition of the parcel received. Delivery can be made only to valid residential or commercial addresses, which excludes P.O. boxes and similar ‘service provision’ addresses.
(3)When you receive your order, it is your responsibility to examine all products carefully for any damage. If there is any damage or if, for example, a parcel shows any signs of damage whatsoever you must notify us on the day of you receive it. Where a signed for service is used, please sign for it as 'Received Damaged'.
(4) Expected estimated delivery times from receipt of cleared payment vary with each Artist. Expected delivery dates for each item is clearly shown in the item description. Where no expected delivery details are shown, products are usually despatched within 7 working days of cleared payment.  
(5) Whilst Artists will use their reasonable endeavours to supply products within any time estimate neither they, nor us, will be responsible for any failure to provide products nor any unavailability nor any losses or damage resulting from a failure to provide or any delay.
(6) International sales
(a) If you are importing any of items from the website you acknowledge that you are solely responsible for compliance with importing laws and requirements of the country to which the item is shipped and this is entirely at your own expense and risk.
(b) In addition to the purchase price of the item, you accept full responsibility for any and all handling charges, shipping costs, insurance, import duties, fees, liabilities and tax/duty costs, which may arise or apply to your order and transportation.
(c) Whilst Artists will do all they can to assist (e.g. special packaging etc which may involve extra payment by you) neither they, nor us, will be responsible for any non-delivery or import duty charged or any fines or impositions as a result of any import or attempted import.
(7) Taking delivery of sent products is entirely your responsibility. If you are unable to take delivery and the products are returned to the Artist they will arrange redelivery at your additional expense. In any event, the delivery charges are always non-refundable.
 
6.  Returns
(1) In the unlikely event that you have received faulty products, products sent in error or you wish to return an item, you must comply with clause 5(3), where appropriate. You must then contact us at info@uniquelycrafted.co.uk within 7 days of receipt to advise us giving details of the item, your order number, the Artist of the item and the fault. When you contact us you will be given a return number which must be enclosed when you return the item. We will inform the Artist on your behalf.
(a) You must return the item to the address it was delivered from. This will usually be on the parcel sent to you, but to recover this address you can email
info@uniquelycrafted.co.uk, again quoting your order details.
(b) Any items must be returned unused in their original packaging, using any forms or reference numbers provided to you by the Artist and with the returns reference number marked on the exterior of the package.
(c) Items should be sent by post (hand delivery is not accepted) using a guaranteed delivery service with item reference number capable of being tracked and traced on-line, such as Royal Mail Recorded or Next Day, with sufficient value transit insurance (you must retain stamped proof of all this), as neither Artist nor we can be held liable for lost or further damage of the items. Only where items are delivered to you by courier should you return them by courier.
(d) Once the Artist has received the returned item safely then,you will receivea refund for the item(s), this will be directly from Uniquely Crafted within 30 days of receipt of the returned item by the Artist. When you have made a card payment credit will be made only to the original card you used to make the payment.
(2) You are always responsible for returning items to the Artist, whether they are faulty or not, and must comply with this policy. An item is deemed to be returned only when it has been received by the Artist. Returns must always be received using the method of initial delivery within 14 days of your receipt of the products in the first place. If you return an item and it is not received by the Artist, then you must submit a claim to the carrier you used to return it (e.g. Royal Mail) to be compensated for the loss of that item.
(3) If you are returning products because they are faulty then you will be reimbursed by Uniquely Crafted LTD for the delivery or postage or packaging charges incurred in returning the item(s) to the Artist only when you supply Uniquely Crafted with your proof of cost of postage.
(4) If you are returning an item for any other reason than the Artist’s error (i.e. sending the wrong item) or they are faulty, then the products should be received by the Artist unopened and in a saleable condition. You will not be entitled to a refund of postage or packaging charges incurred in returning the item(s) to the Artist.
(5) Please be aware that the cost of additions such as gift-wrapping are never refundable unless you are returning products which are faulty or sent because of the Artist’s error.
 
7.  Copyright, Intellectual Property & Use
(1) Use of the website is at your own risk and by licence only for personal use and you acknowledge and agree that all copyright, trademarks, patents and all and any other intellectual property rights in all materials and/or content and products made available as part of your use of this website shall remain at all times vested in us or the Artist, as appropriate.
(2) You may not, nor assist any other person or organisation, as to either all or any part of material, content or otherwise, to download, copy, assign, transmit, publish, display, use, reproduce, distribute, modify, make derivative works, create Internet "links" to the website without our express permission in writing including use of our name and any copyrighted or trademarked content.
(3) We cannot guarantee that the provision of the website will be uninterrupted, secure or error-free nor free of viruses or anything which may affect the use nor will we be held liable for such. The website is provided on an “as is” and “as available” basis.
(4) In addition, we make no warranty against electronic viruses, worms or any other defect or problems which may occur in respect of any viewing or use of the website.
(5) We will not be responsible for any loss or damage whatsoever caused resulting from a failure to provide or where a virus or defect occurs as a result of any e-mail or document we send you.  
(6) We do not check, control, validate, amend, edit or endorse either the Artist’s listings of their own items on the website, nor are we responsible for any information or other content provided by Artists, advertisers nor any links to other websites or other information which is made available through the website.
(7) We have made every effort to ensure that products are displayed as accurately as possible but can not be responsible for variations. Please also see clause 2(7). What you see depends (particularly in so far as colours and shapes are concerned) on your monitor and settings and we can not guarantee this will be accurate.

8.  Liability Disclaimer
(1) To the extent that the law allows we will not be held responsible for any loss, incidental or consequential damage, or loss arising out of use (unauthorised or otherwise), errors, mistakes, accident, theft or fraud, destruction, purchase, or any part of the supply of Artist’s items or use of our website.
(2) In the unlikely event that we would be held liable for anything whatsoever then, to the extent that the law allows, any aggregate liability  whatsoever shall be limited to 100% of the amount paid by you for the products involved in the incident or series of incidents.
(3) We take all reasonable precautions to keep the details of your order and payment secure, but, unless we are negligent, we cannot be held liable for any losses caused as a result of unauthorised access to information you provided.
(4) You are solely responsible for providing correct information, particularly when choosing customised items, such as spellings of names, dates etc. Please also refer to clause 12.
(5) You are also responsible for providing correct delivery information and neither we nor the Artists can be held responsible for any losses whatsoever in this regard.
(6) We do not intend to affect your statutory rights as a consumer.
 
9.  Your Responsibility and Misuse
(1) You agree that you will solely be responsible for your use of any items provided to you and that you will use the product legally and only for the purposes that it is intended to be used for and at all times in accordance with any Artist’s or manufacturer’s instructions, advice, suggestion and information.  
(2) You agree that you will not misuse any products supplied and that you will abide by any laws applicable to this agreement or the operation of it.
(3) With all items, it is your responsibility to ensure that the item is suitable for your use.
(4) Furthermore you agree that you will not misuse the website in any way, including unauthorised access and the introduction of viruses or any other damaging material, and that you will abide by any laws applicable to the website and these Terms and Conditions.
(5) You specifically agree that we have no liability and furthermore you will indemnify us for any loss resulting in any breach of this clause.
 
10.  Your Information & Data Protection
(1) Any use of the website and/or goods supplied will be reliant on information provided by you, so you are responsible for ensuring that any information you provide is accurate, correct and up-to-date. Please also see clause 9.
(2) Any information will be held in accordance with current Data Protection legislation.
(3) Please refer to our Privacy Policy. You are entitled to ask for a copy of your information (for which we may charge a small fee).
(4) If you give us information about another individual or organisation it is on the basis that they have agreed to this.
(5)For security of online payment see clause 4.
 
11.  Assignment
(1) Any rights given cannot be transferred, sold, rented or shared in any way by you and nobody else can benefit but you. A copy of these terms will be admissible in the case of any dispute or in any proceedings.
(2) We reserve the right to assign and/or sub-contract.

12.  Electronic Ordering and/or Products  
(1) You can cancel any order made via our web-site within 7 days of receiving the products. For our Returns Policy, please refer to clause 6. We will then refund any amount you have paid within 30 days of receiving your cancellation.  
(2) However, when you purchase any personalised products and/or any perishable items you waive your cancellation or refund rights under Regulation 13 of the Consumer Protection (Distance Selling) Regulations 2000 (as amended).

13.  Time Estimate

Artists use reasonable endeavours to complete any supply of items within any time estimate given. However, neither we nor the Artists will be liable for any loss or damage suffered because of any unavoidable or reasonable delay in completion, including third party involvement.

14.  Queries, Complaints, Notices  
(1) We aim to respond to any queries or complaints about our website within 7 working days. Please contact us at info@uniquelycrafted.co.uk

(2) Complaints about items should be addressed to the Artist directly, using the address that the product you are complaining about originated from. To recover this address you can email us at
info@uniquelycrafted.co.uk, again quoting your order details. If you complain to us about an item, we will pass the details on to the Artist and confirm to you that we have done this.
(3) If any complaint may amount to a breach of any term herein, then you must allow the Artist, or us, as appropriate dependant on the nature of your complaint, 30 days to remedy that breach.
(4) Any notices for Artists regarding products must be in writing and sent to the Artist who offers the item for sale at the address on the delivery note. To recover this address you can email us at info@uniquelycrafted.co.uk

(5) Any notice for us must be in writing and sent to the address which appears in the definitions above.
(6) Any notice for you will be sent to your address, as appears on your last order.
(7) Notices will be deemed to have been received on the 7th day after posting using Royal Mail 1st class service provided that a duly stamped proof of posting is obtained from Royal Mail.

15.  Generally
(1) We reserve the right to vary our Terms and Conditions at any time and such variation takes effect when they are posted on the website. It is your responsibility to read Terms and Conditions on each occasion you use or purchase from the website and your continued use of our website shall confirm your acceptance to be bound by the latest Terms and Conditions.
(2) These Terms and Conditions supersede any and all prior representations, understandings and agreements.
 
16.  Invalidity
Each clause or any part at all of this agreement is to be regarded as independent of the others.  This means that should any clause or any part at all of this agreement be found to be unenforceable or invalid it will not affect the enforceability or validity of the rest of this agreement.
 

17.  Jurisdiction
These Terms & Conditions shall be interpreted, construed and enforced in accordance with English law and shall be subject to the exclusive jurisdiction of the English Courts.
